Terms of Use
Last updated: [TODO: date you publish]
The short version
- You need to be 13 or older to use Chetely.
- Be kind. No harassment, no explicit content, no dangerous penalties. We remove content and accounts that break these rules.
- Penalties in Chetely are just for fun. No money changes hands between users.
- Chetely Plus is bought by a group owner, renews automatically and can be cancelled any time in your App Store or Google Play settings.
- Your content stays yours. We only use it to run Chetely for you and your groups.
1. About these terms
These Terms of Use are an agreement between you and Alikhan Daulet, an individual based in the United Kingdom who operates Chetely ("we", "us", "our"). [TODO: confirm operator name. It must match the App Store seller.] They apply to the Chetely app and to chetely.com.
By creating an account or using Chetely, you agree to these terms. Please also read our Privacy Policy, which explains how we handle your personal data. If you do not agree, please do not use Chetely.
2. Your account
- You must be at least 13 years old to use Chetely. If you are under 18, you should have permission from a parent or guardian, especially before making any purchase.
- Give accurate information when you sign up and keep it up to date.
- Keep your sign-in details secure. You are responsible for what happens on your account.
- One account per person. Do not create accounts for other people or share your account.
3. How Chetely works
In Chetely, friends form groups that share habits. A group's streak grows on each day that at least 70% of its members (rounded up) complete their shared habits. Days follow the group's time zone. You can also keep personal habits that only you can see.
Streaks, badges and other rewards in Chetely are for motivation only. They have no monetary value and cannot be exchanged or transferred. We work hard to calculate them correctly, but occasional errors or outages can happen, and we cannot guarantee that a streak will never be affected.
4. Groups and owners
- The person who creates a group is its owner. The owner can edit the group, manage its shared habits, set its penalty, remove members, create a new invite code and delete the group.
- Members can leave a group at any time. An owner cannot leave their own group, but can delete it.
- Deleting a group removes it, including its feed, for all members.
- Owners are responsible for who they invite and for the shared habits and penalty they set.
5. Penalties
Groups can agree on a playful penalty for breaking the streak, written as text. Penalties are just for fun:
- Chetely does not collect, hold or transfer money between users, and penalties must not involve money, bets or gambling.
- Penalties must not be dangerous, illegal, sexual, humiliating or harmful to anyone.
- Nobody is ever obliged to carry out a penalty.
6. Your content
"Your content" means anything you add to Chetely, such as habits, check-ins, photos, reactions, suggestions and penalty text.
- You keep ownership of your content.
- You give us a non-exclusive, worldwide, royalty-free licence to store, copy, display and send your content only as needed to run Chetely for you and the groups you share it with. This licence ends when your content is deleted, except for copies kept for a limited time in backups or where the law requires us to keep them.
- You are responsible for your content. Only post content you have the right to share, and do not post photos of other people without their permission.
7. Community rules
We have zero tolerance for objectionable content and abusive users. When using Chetely, you must not:
- harass, bully, threaten or intimidate anyone;
- post hateful content, or content that discriminates against people for who they are;
- post nudity, sexual content or graphic violence;
- post anything that sexualises, exploits or endangers children;
- encourage self-harm, eating disorders or dangerous challenges;
- post anything illegal, or share someone else's private information;
- impersonate anyone, or mislead people about who you are;
- send spam, advertising or scams;
- try to access accounts or data that are not yours, interfere with the app, scrape it, reverse engineer it or get around its limits or payments.
8. Reporting and blocking
You can report any post or photo, and block any user, from inside the app. A blocked user's content is hidden from you everywhere in Chetely.
We aim to review reports within 24 hours. We may remove content and suspend or permanently remove accounts that break these terms. We do not review all content before it appears, so please report anything that worries you.
If someone is in immediate danger, contact the emergency services (999 in the UK) first.
9. Chetely Plus
What it is
Chetely is free to use. Chetely Plus is an optional subscription bought by a group owner. While it is active, it unlocks Plus features for every group that person owns, including groups of up to 25 members instead of 5, and the other Plus features described in the app. Members of a Plus group do not pay anything.
Price and free trial
- In the UK, Chetely Plus costs £3.99 a month or £24.99 a year, including VAT. Prices may differ in other countries and currencies. The price that applies to you is always shown in the app before you buy.
- Eligible new subscribers get a 7-day free trial. Unless you cancel at least 24 hours before the trial ends, it turns into a paid subscription and you will be charged. Trial eligibility is decided by the App Store or Google Play.
Automatic renewal
Your subscription renews automatically for the same period (a month or a year) at the then-current price, unless you cancel at least 24 hours before the end of the current period. Your App Store or Google Play account is charged within the 24 hours before the renewal.
How to cancel
- iPhone: open Settings, tap your name, then Subscriptions, then Chetely.
- Android: open Google Play, tap your profile picture, then Payments & subscriptions, then Subscriptions.
If you cancel, Plus stays active until the end of the period you have paid for. Deleting the app or your Chetely account does not cancel your subscription.
Payments and refunds
Payments are processed by Apple or Google under their terms, not by us. To ask for a refund, use Apple's reportaproblem.apple.com or Google Play's refund process. We cannot issue refunds for store purchases ourselves. This does not affect your legal rights as a consumer.
When Plus ends
[TODO: decide and describe what happens to a group with more than 5 members when the owner's Plus ends. For example: existing members stay, nobody new can join until the group is back to 5, and Plus-only features switch off.]
Price changes
If we change the price of Chetely Plus, you will be told in advance as required by the App Store or Google Play, and by law. If you do not agree to a new price, you can cancel before it takes effect.
10. Health and wellbeing
Chetely helps you build habits. It does not give medical, health, fitness or nutritional advice. Talk to a qualified professional before starting any new exercise, diet or health routine, and stop if something does not feel right. Do not use Chetely in a way that puts you or others at risk, for example while driving.
11. Our app and brand
The Chetely app, website, name, logo and design belong to us or our licensors. We give you a personal, non-exclusive, non-transferable, revocable licence to use the app for your own non-commercial use, in line with these terms. You may not copy, sell or build on Chetely without our written permission.
12. Changes to Chetely and these terms
We are always improving Chetely, so features may change, be added or be removed. If we make a change that significantly affects you, we will tell you in advance where we reasonably can.
We may update these terms from time to time. If the changes are important, we will let you know in the app or by email before they take effect. If you keep using Chetely after that, the new terms apply. If you do not agree, you can stop using Chetely and delete your account.
13. Ending your use of Chetely
- You can stop using Chetely and delete your account at any time in the app (You, then Settings, then Delete account).
- We may suspend or close your account if you seriously or repeatedly break these terms, if the law requires it, or to protect other users. Where appropriate, we will tell you why.
- If we decide to shut Chetely down entirely, we will give you reasonable notice.
14. Our responsibility to you
- Nothing in these terms limits our liability for death or personal injury caused by our negligence, for fraud, or for anything else that cannot be limited by law. Your legal rights as a consumer are not affected.
- We are responsible for loss or damage you suffer that is a foreseeable result of us breaking these terms or failing to use reasonable care and skill. We are not responsible for loss or damage that was not foreseeable.
- Chetely is for personal use. We are not responsible for business losses, such as lost profit or lost business opportunities.
- We are not responsible for content posted by other users, or for what other users do, including penalties they set or carry out.
- To the extent the law allows, our total liability to you is limited to the greater of the amount you paid for Chetely Plus in the 12 months before the claim, or £50.
15. App Store and Google Play
If you downloaded Chetely from Apple's App Store, the following also applies:
- These terms are between you and us, not Apple. We, not Apple, are solely responsible for Chetely and its content.
- Your licence to use Chetely is limited to Apple-branded products that you own or control, as permitted by the Usage Rules in Apple's Media Services Terms and Conditions, except that the app may be accessed by other accounts associated with you through Family Sharing.
- We are solely responsible for maintenance and support of Chetely. Apple has no obligation to provide any maintenance or support.
- If Chetely fails to meet any applicable warranty, you may notify Apple, and Apple will refund the purchase price (if any) for the app. To the maximum extent permitted by law, Apple has no other warranty obligation for Chetely.
- We, not Apple, are responsible for addressing any claims by you or a third party relating to Chetely, including product liability claims, claims that Chetely fails to meet a legal or regulatory requirement, and claims under consumer protection, privacy or similar laws.
- If a third party claims that Chetely or your use of it infringes their intellectual property rights, we, not Apple, are responsible for investigating, defending, settling and discharging that claim.
- You confirm that you are not located in a country subject to a US Government embargo or designated as a "terrorist supporting" country, and that you are not on any US Government list of prohibited or restricted parties.
- You must comply with any applicable third-party terms when using Chetely.
- Apple and its subsidiaries are third-party beneficiaries of these terms and, once you accept them, Apple has the right to enforce them against you as a third-party beneficiary.
If you downloaded Chetely from Google Play, Google's terms also apply to your download and purchases, and Google is not responsible for Chetely.
16. Law and disputes
These terms are governed by the law of England and Wales. Any dispute will be dealt with by the courts of England and Wales, except that if you live in Scotland or Northern Ireland you can also bring proceedings in your local courts. If you live elsewhere, you keep any protections given to you by the mandatory laws of your country.
If you have a problem, please contact us first. Most issues can be sorted out quickly by email.
17. General
- If any part of these terms is found to be unenforceable, the rest stays in effect.
- If we do not enforce a right straight away, we can still enforce it later.
- We may transfer our rights and obligations under these terms to another person or organisation, for example if Chetely is run by a company in future. We will tell you if this happens, and it will not reduce your rights. You may not transfer your rights under these terms.
- Apart from Apple as described in section 15, nobody else has any rights under these terms.
- These terms, together with our Privacy Policy, are the whole agreement between you and us about Chetely.
